As a result, the employer reviewed its records to ensure it identified and notified any potentially qualified U.S. workers impacted by the reduction in force. Following regulatory and BALCA guidance, the employer considered U.S. workers to be potentially qualified if they were employed in the area of intended employment, in a related occupation, and held or could possibly hold the minimum requirements, or could gain the minimum qualifications through a reasonable period of onthejob training. To determine whether any potentiallyqualified U.S. workers were impacted, QuantumScape Battery, Inc. initially reviewed its employment records for job title and job location of all laid off workers, and reviewed whether any of the impacted individuals in the same or similar occupation were U.S. workers. The result of this review was that there were three impacted U.S. workers in the area of intended employment or in a related occupation, and they were found to be clearly unqualified as they lacked the minimum educational and experience requirements and numerous skills required for the position for which certification is sought.
