Please see the following;br 1. The Beneficiary is not employed by the Company. He does not have any influence on any hiring or firing decisions within the Company.br 2. The Beneficiary is the Brother of the Company owner Baran Menguloglu.br 3. The Beneficiary is not an incorporator or the founder of the Company.br 4. The Beneficiary does not have an ownership interest in the Company, also he never had an ownership interest in the Company before.br 5. The Beneficiary is not working with the Company and he is not involved in the Management.br 6. The Beneficiary is not on the Board of Directors.br 7. Since the Beneficiary is not and has never been employed by the Company, he is not and has never been one of the small numbers of employees. Also, the petitioner is a medium size company having 15 employees.br 8. As it can be seen from the job duties, they are not tailored for the Beneficiarys qualifications.br 9. The Company does not employ the Beneficiary. The Companys business operations are not dependent on the Beneficiarys presence. The Company continues its business operations without the Beneficiarys presence. However, the Company needs a Financial Analyst.
