FAMILIAL RELATIONSHIP EXPLANATION Please note that the beneficiary of this application, Ms. Montalvan Lopez de Aguilar, has a familial relationship to me, the owner of the business, in that I am her sister. The business, therefore, took strict measures to ensure the integrity of the search described herein. To demonstrate that our business conducted a goodfaith test of the labor market and is making a bona fide job offer to Ms. Montalvan Lopez de Aguilar, we submit the following points for considerationbr br 1. While my cleaning business normally has responsibility for hiring procedures, including advertising, interviewing, and the like, in seeking to permanently fill the instant housekeeping position, I engaged an outside service to assist with the recruitment process. All correspondence was directed to that outside service and neither I nor the applicant had any participation in the process whatsoever.br 2. Ms. Montalvan Lopez de Aguilar has no ownership interest in the business. I am the sole owner of the business and I possess and exercise final authority over employment and other decisions on behalf of the practice. Further, Ms. Montalvan Lopez de Aguilar has had and will have absolutely no involvement, control or influence over the process of recruiting and considering applicants for positions.br 3. The business is genuinely seeking to fill this position on a permanent basis. We need someone on a permanent basis as this part of Maine lacks applicants for these types of services. We have been struggling for some time and the additional employee will greatly improve our chances for success.br 4. As a highly reputed business owner within the communities where I live and work, I have every incentive to comply with the law. I understand that it would be fraudulent to advertise a position to the public without giving true consideration to all applicants. Further, I understood that by following the appropriate procedures in order to test the labor market and determine whether Ms. Montalvan Lopez de Aguilar is the only minimally qualified candidate for the position and thus permitted to fill it permanently could result in finding another individual. This latter scenario is something that I would both accept and understand as a requirement for compliance with the law. However, we did not receive any applications from U.S. workers for this position in response to our recruitment efforts in compliance with regulatory requirements.br 5. We based the position requirements on the duties we need performed and nothing more. They are minimal, but there is no one in central Maine applying for these types of jobs, evidenced by the lack of applications for the position. Ms. Montalvan Lopez de Aguilar is the only choice, and I am therefore filing this application in order to secure her assistance with my cleaning business.
